Freedom Of Information ACT.
The Freedom of Information Act (the FOI Act) is separate and unique legislation and provides for a strict process to be followed in responding to applications. It will only be used in circumstances where the request for information or documents, cannot be dealt with under other legislation. The FOI Act application form will need to be completed and the application fee of $30 must accompany any completed application lodged with Council.
You will be advised of the process involved and whether third parties are to be consulted. In matters dealing with your personal affairs, the application fee covers the first 20 hours of processing time. In other events, a processing fee of $30 per hour applies. You may be required to pay an Advance Deposit .Applications must be determined within 21 days and extensions of time will apply to enable the consultation process (where applicable). You will then receive a Notice of Determination from the Freedom of Information Officer. You will be notified of your rights to appeal any determination.
