Fifth Deed of Variation to Elara Marsden Park Planning Agreement

In accordance with Section 7.5 of the Environmental Planning and Assessment Act 1979 and Clause 25D of the Environmental Planning and Assessment Regulation 2000, notice is hereby given that Council proposes to enter into a fifth Deed of Variation to the Marsden Park Planning Agreement with Stockland Development Pty Limited, for its Elara Development in Marsden Park. 

The Draft Deed of Variation relates to the same Development the subject of the Planning Agreement, expanded to:

  • include an additional stage in Precinct 1, additional medium density stages in Precinct 3, an additional stage in Precinct 5b and Precinct 6 in the definition of a Staged DA
  • include additional Development Contributions for Precinct 1, Precinct 3, Precinct 5b and Precinct 6, being monetary contributions (as a Staged DA)
  • update the Act references to reflect the latest amendments that commenced on 1 March 2018.

 How to make a submission

The exhibition period will run from 27 June 2018 to 24 July 2018.

Parties wishing to make comment on the Fifth Deed of Variation to Elara Marsden Park Planning Agreement are invited to forward written submissions to Council by 5:30PM by 24 July 2018. Please quote file reference: F13/933 addressing your submission to:
