Property Dealing Applications

Step 1.Engage a solicitor, conveyancer or surveyor

Before preparing a Property Dealing application, you will need to engage a qualified professional to prepare the relevant

  1. Land Title Dealing Form OR

  2. Plan and associated documentation

Step 2.Gather the required supporting documents

To begin preparing your application, please locate the relevant application form  below.

Each application will require different supporting documents. 

Please refer to the checklist attached to the application form for a list of required supporting documents relevant to your application.

Step 3.Apply

Once you have completed the relevant application form and gathered the required supporting documents set out in the checklist, please submit your application by email to subdivisioncertificates@blacktown.nsw.gov.au 

Your application will not be accepted until all required supporting documents have been provided.

Certain developments may be exempt from Subdivision Certificate consent by legislation. Types of developments that may fall under the exempt criteria include:

  • plan of easement

  • plan of redefinition

  • boundary adjustment

  • plan of acquisition

  • plan of consolidation.

Creation of Land Title Dealings

Land Title dealings can be created by:

  • Stand-Alone Dealing Form (Section 88E Instrument)
    Standalone dealing forms do not require an associated plan.

Releasing a Land Title Dealing

Where Council is the authority to release, vary or modify a registered dealing, you can apply for Council endorsement of a:

  • release or extinguishment of Positive Covenant

  • release or extinguishment of Restriction on the Use of Land

  • cancellation or extinguishment of Easement

  • transfer granting Easement.
