Works-In-Kind Agreements (more commonly known as WIK Agreements) is an agreement that a developer may seek in order to construct or provide public infrastructure or amenities in whole or part in lieu of making a monetary contribution under a Section 7.11 condition authorised by a contributions plan.

Fees associated with Works-In-Kind

A summary of the fees are noted below:

Works-in-Kind proposal fee

 $327 for for each full Section 7.11 work listed in a contributions plan

 $341 for for each full Section 7.11 work listed in a contributions plan

 $670 for each part of a Section 7.11 work listed in a contributions plan

 $700 for each part of a Section 7.11 work listed in a contributions plan

 Works-in-Kind supervision fee
 The lessor of 5% of the value of each full or part Section 7.11 work listed in a contributions plan; and $80,000 for each full or part Section 7.11 work listed in a contributions plan

 Works-in-Kind design review fee
 0.3% of the Section 7.11 contributions plan capital works value, with a minimum fee of $530 and an upper limit of $31,800

Legislation

  • Environmental Planning and Assessment Act 1979 - Provides the the provision of works-in-kind to the Council in part or full satisfaction of a Section 7.11 Condition pursuant to s7.11(5)(b) . For more details see Part 7 Division 7.1 Subdivision 3 at NSW legislation
